1031 Exchange Transactions in Terra Bella

Two transactions. Two federal deadlines. No room for drift.

Deadlines That Do Not Move

Section 1031 can let a holder of investment or business real estate sell, roll the proceeds into like-kind property and possibly push the tax on the gain into the future. The rules leave no slack. Closing on the relinquished property starts the count: day 45 is the last day to identify replacements in writing, day 180 the last day to own one. Blow either and the exchange may collapse. Real Estate Agent Terra Bella covers the property side. Pricing, marketing and selling what you are giving up. Hunting, vetting and negotiating what you are getting. One calendar for both escrows. The qualified intermediary holds the money. Eligibility and the tax consequences are your tax advisor's call. Tax advice is not part of our role. What is: a replacement search that begins before the first escrow closes when that helps, a straight answer on whether a target can realistically close in time, and replacement offers that stay disciplined on price even with the clock running. Groves, rental houses and commercial buildings may all qualify, depending on how they are held.

Exchange Coordination in Detail

The real estate side, handled on one calendar.

  • Deadline calendar

Identification and closing dates set the day the sale closes, with early warnings.

  • Relinquished property sale

Priced, marketed and negotiated with exchange language in the contract.

  • Early replacement search

Candidates reviewed before the first escrow closes, so the clock is not wasted.

  • Identification support

Help selecting properties to identify, each with a realistic path to closing.

  • Disciplined replacement offers

Time pressure is real, but the offer is still capped by comparable sales.

  • Intermediary coordination

Escrow, title and the intermediary aligned on documents and fund transfers.

  • Advisor checkpoints

Key decisions routed to your tax advisor before commitment.

  • Broad property types

Groves, rentals, commercial buildings and investment land considered.

Exchange Steps

  1. Assemble the team

Qualified intermediary engaged and tax advisor consulted before listing. Replacement goals and calendar set.

  2. Sell and identify

Relinquished property sold with exchange terms. The 45-day period starts at closing, and the identification list is finalized within it.

  3. Acquire

Replacement negotiated, diligence tracked and escrow held to a closing within 180 days of the first sale.

Exchange Clients Get Three Things

  • Calendar discipline

Exchange dates are fixed. They are tracked from day one.

  • Price discipline

Deadlines do not justify overpaying for the replacement.

  • Roles respected

Real estate here. Funds with the intermediary. Tax advice with your advisor.

  • Identification date tracked
  • Closing deadline held
  • Intermediary coordinated
  • Tax questions to your advisor
